Public Offer

1. Terms and Definitions

• Offer - this document published on the FoodDuck AI website and addressed to individuals who want to receive paid access to Service functions.
• Contractor - the person providing paid access to the Service and listed in the Contractor Details section of this Offer.
• User - an individual who accepts this Offer, pays for paid access, or uses the Service after payment.
• Service or FoodDuck AI - the Telegram bot and related website pages intended for informational AI analysis of photos of meals, food products, packages, ingredients, and other User materials.
• Plan - the paid access volume selected by the User, including limits, validity period, processing priority, and other conditions.
• Acceptance - the User's full and unconditional acceptance of this Offer by paying for a paid plan or performing another action expressly shown in the Service interface as acceptance of the terms.

2. Subject of the Offer

The Contractor provides the User with paid access to Service functions under the selected plan, and the User pays for such access and uses the Service in accordance with this Offer, the User Agreement, and the Personal Data Processing Policy.

Paid access is intended for receiving informational analysis results for User requests within the limits, validity period, and technical capabilities of the selected plan.

The Service does not provide medical, dietetic, sanitary, laboratory, expert, or other professional services. Analysis Results are reference information and do not replace professional advice.

3. Agreement Conclusion and Access Provision

Before payment, the User sees the plan name, cost, validity period, key limits, and other material access conditions in the Service interface.

An agreement under this Offer is considered concluded when the User accepts the Offer.

Paid access is activated automatically after the Contractor receives successful payment confirmation from the payment service.

If access is not activated automatically, the User may contact support and provide data that makes it possible to find the payment and the User account.

The Contractor's obligation to provide access is considered fulfilled when the selected plan is activated or the User is given the technical ability to use the paid Service functions.

4. Price and Payment Procedure

The cost of paid access is determined by the selected plan and is shown to the User before payment on the FoodDuck AI website and/or in the Telegram bot.

Payment is made in Russian rubles by non-cash payment through Robokassa or another payment tool available in the Service interface.

The User's payment obligation is considered fulfilled after the payment service confirms successful payment.

A fiscal receipt is generated and sent to the User in the manner required by Russian law and payment service settings.

The User independently pays commissions of banks, payment systems, communication operators, and Internet providers if such commissions apply.

5. User Rights and Obligations

• Use paid access for its intended purpose within the selected plan and technical capabilities of the Service.
• Independently ensure access to Telegram, the Internet, and a device required to use the Service.
• Provide accurate data during payment and support requests.
• Not transfer access to their Telegram account to third parties and independently be responsible for actions made through that account.
• Not bypass limits, disrupt Service operation, obtain unauthorized access, or send automated mass requests.
• Not use Analysis Results as the sole basis for medical, dietetic, sanitary, legally significant, or other responsible decisions.

6. Contractor Rights and Obligations

• Provide the User with paid access in the volume, period, and on the conditions of the selected plan after payment confirmation.
• Change plan composition, prices, limits, processing priority, and individual Service functions. Such changes do not reduce already paid access unless required by law or Service technical security.
• Temporarily restrict or suspend the Service for updates, maintenance, error correction, abuse prevention, or reasons beyond the Contractor's control.
• Restrict User access in case of violation of this Offer, the User Agreement, legal requirements, or Service technical rules.
• Request information from the User that is necessary to find a payment, activate access, process a support request, or review a refund.

7. Limitations and Result Quality

The Service is provided within technical availability and on an "as is" basis. The Contractor does not guarantee uninterrupted Service operation or absence of errors, delays, Telegram failures, payment service failures, communication provider failures, AI provider failures, or other external system failures.

Analysis Results are generated automatically and may contain inaccuracies caused by photo quality, angle, lighting, hidden ingredients, incomplete data, labeling errors, or AI model limitations.

The Contractor does not guarantee absolute accuracy, completeness, applicability, or suitability of Analysis Results for any specific User purpose.

8. Refunds

Refunds are reviewed under the Refund Policy section of the User Agreement and applicable Russian law.

If paid access has been activated and the User actually started using the plan functions, a refund is made only in cases provided by law, this Offer, or the User Agreement.

When a refund basis is confirmed, the refund is made using the same payment method that was used for payment, if technically possible. The crediting period depends on the bank, payment system, and Robokassa rules.

9. Personal Data and Confidentiality

The User's personal data is processed to conclude and perform the agreement, process payments, activate access, account for limits, support users, ensure security, and comply with legal requirements.

Detailed personal data processing terms are published in the Personal Data Processing Policy.

The Contractor may use anonymized Service usage statistics to analyze load, improve quality, security, and operational stability.

10. Liability of the Parties

The parties are liable for non-performance or improper performance of this Offer in accordance with Russian law.

The Contractor is not liable for decisions made by the User based on Analysis Results, consequences of consuming, purchasing, storing, or preparing food products, or harm caused by incorrect interpretation of reference information, unless otherwise expressly required by law.

The User is responsible for the accuracy of submitted information, the lawfulness of submitted materials, the security of their Telegram account, and the consequences of using the Service.

11. Offer Amendments and Access Termination

The Contractor may amend this Offer unilaterally. A new version enters into force upon publication on the FoodDuck AI website unless another effective date is specified in that version.

The User must independently review the current version of the Offer. Payment or continued use of paid functions after a new version is published means that the User agrees to the amendments.

Termination of Service use does not release the parties from obligations that arose before such termination.

12. Dispute Resolution

This Offer and the relationship between the parties are governed by the laws of the Russian Federation.

The parties seek to resolve disputes through negotiations and exchange of requests through support contacts. The response period for a written claim is up to 10 business days unless another period is established by law.

If a dispute cannot be resolved through the claim procedure, it is subject to review by a court according to the jurisdiction rules established by Russian law.
